Definition: Triple talaq is the practice under which a Muslim man can divorce his wife by simply uttering “talaq” three times. It is prevalent among India’s Muslim community majority of whom follow the Hanafi Islamic school of law.
India is one of a handful of countries where a Muslim man can divorce his wife in minutes by saying the word talaq (divorce) three times. This has been an issue of concern for over 65 years for Muslim women, who comprise approximately 8% of the population as per the 2011 census.
This issue has attracted media attention in the past two years since a Muslim organisation, Bharatiya Muslim Mahila Andolan (BMMA), launched a campaign to ban triple talaq and “Nikah Halala” – a practice where divorced woman, in case she wants to go back to their first husband, has to consummate a second marriage.
Supreme Court set a five-judge constitution bench to hear and decide the challenge on ‘triple talaq’, ‘nikah Halala’ and polygamy. The landmark court decision came in response to petitions challenging the so-called “triple talaq” custom. Centre, being one of the petitioners, argued that Muslim marriage and divorce is codified under Section 2 of the Shariat Act of 1937 and came within the ambit of ‘law’ under Article 13 of the Constitution and hence they should abide by the principles of dignity and non-discrimination.
Finally, The Supreme Court declared in a majority judgment that the Muslim practice of triple talaq or instant divorce by uttering “talaq (divorce)” three times “illegal and sinful”.
