Environmental Supplemental Plan

The Environment ministry has floated a plan called as an Environmental Supplemental Plan (ESP) to discourage violation of the Environment Impact Assessment (EIA) guidelines, 2006 for clearing projects that have started constructions or made expansions without obtaining an environment clearance (EC).

What is technical definition of ESP?

  • An Environmental Supplemental Plan (ESP) is an environmentally beneficial project or activity that is not required by law, but that an alleged violator of Environmental Impact Assessment Notification, 2006 agrees to do to be eligible for environmental clearance.

Eligibility for ESP

  • The proposed ESP to be consistent with all statutory and Constitutional requirements. Sufficient interrelation between the violation and the proposed project. Besides, the project has to be consistent with every provision of the underlying statutes that prompted the action for violation.

Key Feature

  • In the new plan, the expert appraisal committee or the state expert appraisal committee will refer cases of violations to an expert group to be constituted by the environment ministry under the provisions of the Environment (Protection) Act, 1986 for making an objective and thorough assessment of the pecuniary benefit of non-compliance and damage caused to the environment.
  • The expert group will prepare an ESP for restoration of the damage caused to the environment. If there is no expert group in a state the project will be appraised by the ministry.

The notification is silent on the quantum of penalty when the ‘polluter pays’ principle is invoked.
