NGT STAY ON FELLING OF COCONUT TREES IN AGATTI ISLAND

  • The Southern bench National Green Tribunal has granted an interim stay on cutting of coconut trees in Agatti Island in Lakshadweep.
  • Applicant Agatti Island Kera Karshaka Sanghom, alleged the cutting down coconut trees to form a beach road was against the Integrated Island Management Plan of Lakshadweep.
  • Integrated Island Management Plan of Lakshadweep was formulated on the basis of the report of the expert committee appointed by the Supreme Court and headed by Retired Justice R.V. Raveendran.

Concerns of the Applicant

  • As per the applicant of the case, with large scale cutting of the coconut trees for the project, the local residents lost their income.
  • Also it would also affect the environment as trees as coconut trees acted as a green belt to protect the land during cyclones and other natural calamities.

About Agatti Island

  • It is a 7.6 km long island, situated on a coral atoll called Agatti atoll in the Union Territory of Lakshadweep, India.

About National Green Tribunal

  • It was established in 2010, as per the National Green Tribunal Act.
  • It is a specialised judicial body equipped with expertise solely for the purpose of adjudicating environmental cases in the country.
  • It was set up as per recommendations of the Supreme Court, Law Commission and India’s international law obligations to develop national laws on environment and implement them effectively.
  • It is tasked to provide effective and expeditious remedy in cases relating to environmental protection, conservation of forests and other natural resources and enforcement of any legal right related to the environment.
  • It has a presence in five zones- North, Central, East, South and West.
  • Its Principal Bench is situated in the North Zone and headquartered in Delhi.
  • Its orders are enforceable as the powers vested are the same as in a civil court under the Code of Civil Procedure, 1908.
